  • Includes the terms, specifications and Incoterms agreed with the buyer

No commercial agreement is considered final until the buyer receives a Proforma Invoice or Sales Contract and confirms acceptance in writing.

5. Orders and Payment Terms

Orders are only considered confirmed once:

  • The buyer has approved the Proforma Invoice or Sales Contract;
  • The agreed payment terms have been fulfilled (deposit, advance or full payment depending on the agreement).

Accepted payment methods, due dates and banking details will be specified in the contract.

Late or incomplete payments may delay production, inspection and shipping.

6. Shipping, Logistics & Delivery

Shipping terms are defined according to the chosen Incoterms® (FOB, CIF, CFR, etc.).

Garra Exports is responsible only for the obligations defined under the selected Incoterm.

We are not responsible for delays caused by:

  • Port congestion.
  • Weather conditions.
  • Customs inspections.
  • Transportation strikes.
  • Shipping line operational changes.
  • Force majeure events.

Any transit times provided are estimates, not guarantees.

7. Quality Control & Inspection

Quality parameters will be agreed with the buyer prior to shipment.

We may offer:

  • Pre-shipment inspections.
  • Lab tests.
  • Certificates of quality.
  • Photos or videos of the loading process.

Any claims regarding quality must be submitted in writing within 7 days after the cargo arrives at destination, with supporting evidence such as:

  • Inspection reports.
  • Photos.
  • Lab results.

Claims submitted after this period may not be accepted.

8. Cancellations and Modifications

Once production, packing or logistics processes have started, cancellations may incur costs or penalties, depending on the stage of the operation.

Modifications to orders must be requested in writing and accepted by both parties.

9. Limitation of Liability

Garra Exports is not responsible for:

  • Damages caused by improper handling after delivery under the Incoterm.
  • Losses due to delays outside our control.
  • Damages caused during maritime transport (covered by shipping line insurance policies).
  • Import restrictions, customs decisions or regulatory changes in the buyer’s country.

The buyer is responsible for complying with local import regulations, permits and taxes.

10. Privacy and Data Protection

Any personal or corporate data submitted through our website or communication channels is used exclusively for:

  • Responding to inquiries.
  • Preparing quotations.
  • Coordinating commercial operations.
